VW Express Delivery Terms and Conditions

Unless the parties agree otherwise in writing, by giving your package to VW Express for carriage you agree to all our terms and conditions.You shall indemnify us and hold us harmless against all liabilities, losses, claims, damages, costs and expenses of any nature whatsoever incurred as a consequence of your non-observance of any regulation required with regards to or in connection with the carriage of goods under this bill of lading.

 

VW Express On-line Order Terms

The use of VW Express’ Internet web site by customers is done at the sole risk of customer. The customer recognizes that within an electronic environment the possibility exists that an electronic order may be delayed from reaching our servers, in the event of such a delay, we cannot be liable for consequential damages and loss of, or potential loss of income or profits. VW Express shall not be liable for any special or consequential damages that result from the inability to use, or issues with the performance of our site. At customer’s request, VW Express will provide an account number and password for the use of a specific company, which will grant access to VW Express’ on-line web site. The customer is responsible for the proper safeguarding of these account numbers and passwords. VW Express shall not be held liable for the unauthorized use of account number and passwords. Customers are responsible to notify VW Express by e-mail of any need to change the status of web site accounts/passwords. Account numbers and passwords for VW Express’ web site may be changed, suspended or deactivated at any time at the sole discretion of VW Express. Orders entered via VW Express’ on-line order entry system shall carry the same weight and obligation as an order place over the telephone with an order taker. Rates displayed online are for information purposes only and are subject to all applicable taxes and surcharges. Displayed rates are subject to change depending on the actual delivery details obtained when the driver picks up the package. Occasionally customer rates, taxes and fuel surcharge must be adjusted. There may be a delay in these rates being updated on our website therefore, rates generated by our system will always supercede a displayed rate online.

Customer Obligations

You warrant that each shipment or delivery is properly described on given waybill and is acceptable for transport by VW Express and that your delivery is properly marked, addressed and packaged to ensure safe transportation with ordinary care in handling. The shipper hereby declares that this consignment does not contain any dangerous substances as defined under the transportation of dangerous goods act. The shipper further declares that he/she fully understands the extent of this declaration.
If your package is a TENDER/BID: After placing your order on-line you MUST also call by phone and confirm your order with an order taker.

Packaging

The carrier VW Express does not provide protective service for the transportation of parcels requiring special protection or protection from heat or cold such as perishables. VW Express reserves the rights to refuse any package which for various reasons we deem to be dangerous or any other character of its contents is liable in the judgment of the carrier to soil, taint, or otherwise damage other goods or equipment or which is economically or operationally impractical to transport or which is improperly packaged or wrapped

Limits on our Liability

Our maximum liability for any loss, damage, or injury to a shipment whether direct, incidental, or consequential is limited to the amount of actual value of the loss up to the maximum of $50 whichever is less. Our maximum declared value is $200. VW Express cannot be liable for values above this maximum declared value. All declared values must be stated at the time delivery order is placed and are subject to additional charges. We cannot be liable for consequential damages outside of delivery parameters loss of, or potential loss of income or profits.

Notice of Damage or Loss

VW Express is not liable for loss or damage for any delivery carried under this waybill unless notice thereof setting out particulars of the origin, destination, date and estimated amount claimed in respect of delivery is given. Notice must be given to VW Express, the carrier within 48 hours after such loss or damage occurs and details in writing within 14 days after shipment delivery. Any notice of claims of loss or damage that is submitted after this 14 day period will not be valid.

Delivery Delay

In event of any delay: VW Express shall not be liable for any special, consequential or other damages caused by delay in the delivery of a shipment, regardless of the cause of such delay. If a delay can be undisputedly proven to be due to the deliberately negligent actions of one of our sub-contractors our liability for delay is limited exclusively to a refund of your delivery charges to the amount of the actual delivery cost up to the maximum of $50, whichever is less. We shall not be liable for any special, consequential or other damages caused by delay in the delivery of a shipment.

VW Express shall not be liable for any loss, damage, destruction or unreasonable delays caused by events we cannot control:

1. Acts of God, the Queen’s or public enemies, extreme weather conditions

2. Riots, Civil Commotions.

3. Strikes, Mechanical Delays.

4. Authority of Law.

5. Defects of the goods shipped.

6. Act of default of the shipper or receiver or owner of the goods.

7. Nuclear reaction, radiation or radioactive contamination.

8. Improper packaging, addressing, or securing of goods

Customer Responsibility for Payment

Regardless of alternate payment instructions you give us, i.e. C.O.D’s collect payment at the drop off location, you will always be primarily responsible for all delivery charges. By giving VW Express your package you agree to make full payment within our payment term. You will always be responsible for any costs we may incur in redelivering, returning, or warehousing your delivery shipment pending disposition

VW Express Refund Policy

VW Express has a 100% Money-Back Refund Policy for all Local Same day delivery orders that are Cancelled within 15 minutes of the time an order is placed, provided that a delivery driver has not yet arrived at the customer’s location to make the pick up or delivery. If a delivery driver arrives at the customer’s pick up or delivery location before the order is cancelled then a minimum $10.00 service charge will be charged to the customer.

VW Express has a 100% Money-Back Refund Policy for all Local Rush delivery orders that are Cancelled within 15 minutes of the time an order is placed, provided that a delivery driver has not yet arrived at the customer’s location to make the pick up or delivery. If a delivery driver arrives at the customer’s pick up or delivery location before the order is cancelled then a minimum $25.00 service charge will be charged to the customer.

VW Express has a 100% Money-Back Refund Policy for all Same day and Rush Out-of-Town delivery orders that are Cancelled within 15 minutes of the time an order is placed, provided that a delivery driver has not yet arrived at the customer’s location to make the pick up or delivery. If the delivery order is cancelled after the 15 minute time period or the delivery driver arrives at the pick up or delivery location before the order is cancelled, then a $25.00 service charge will be charged to the customer.
